Condizioni generali di vendita
1 – Premessa
Le presenti condizioni generali disciplinano la vendita all’asta e/o trattativa
privata dei lotti conferiti alla casa d’aste Aste Bolaffi S.p.a. (di seguito “Aste
Bolaffi”). I lotti posti all’asta sono di proprietà dei conferenti i quali ne hanno
garantito la piena e libera disponibilità e la legittima e lecita provenienza. Aste
Bolaffi agisce esclusivamente quale mandataria del conferente in nome pro-
prio e per conto di esso. Tutto il materiale è garantito dal conferente autentico
e senza difetti occulti, salvo indicazione contraria indicata in catalogo e/o dal
banditore. Ove specificato lo stato di conservazione dei lotti è fornito a titolo
puramente indicativo e non vincolante.
2 – Immagini
I diritti d’autore attinenti a tutte le immagini, illustrazioni e documenti scritti,
realizzati da o per Aste Bolaffi, relativi a un lotto o a un contenuto specifico
del catalogo, sono e rimarranno di proprietà di Aste Bolaffi. Tali contenuti non
potranno pertanto essere utilizzati dall’acquirente e/o da terzi senza il previo
consenso scritto di Aste Bolaffi.
3 – Partecipazione in sala
Aste Bolaffi si riserva il diritto di richiedere ai partecipanti all’asta informazioni
sulle generalità e sulle referenze bancarie, nonché il diritto di vietare a parteci-
panti non desiderati l’ingresso in sala. Qualora il partecipante agisca in nome
e per conto di un’altra persona fisica o giuridica, dovrà essere esibita idonea
procura prima dello svolgimento dell’asta.
4 – Partecipazione per corrispondenza, tramite collegamento telefonico,
online
Con l’invio e la sottoscrizione degli appositi moduli, il partecipante accetta di
prendere parte all’asta di riferimento e si impegna a corrispondere il prezzo
d’acquisto previsto qualora la/le sua/sue offerta/e abbia/no successo. Il par-
tecipante si impegna inoltre a controllare, al termine dell’asta, se la/le sua/
sue offerta/e è/sono andata/e a buon fine sollevando Aste Bolaffi da ogni
responsabilità in tal senso. Contestazioni dovute a negligenza o errore nella
compilazione di offerte scritte per corrispondenza non saranno accettate. Aste
Bolaffi declina ogni responsabilità nei confronti di chi partecipa all’asta median-
te collegamento telefonico e/o online nel caso di mancata esecuzione della
partecipazione dovuta a eventuali disguidi che possono occorrere durante o
precedentemente il collegamento telefonico e/o internet.
5 – Offerte
I lotti verranno aggiudicati al miglior offerente. Aste Bolaffi si riserva il diritto di Lots are awarded to the highest bidder. Aste Bolaffi –reserves the right
annullare l’aggiudicazione in caso di eventuali contestazioni. Non si accettano
offerte inferiori al prezzo di base. Offerte “al meglio”, “salvo visione”, o che
comprendono lotti in alternativa a quello indicato non sono accettate. Il prezzo
di partenza sarà quello indicato come base, salvo quando non siano perve-
nute offerte diverse e più alte, nel qual caso il prezzo di partenza sarà quello
dello scatto successivo alla penultima offerta (In caso di uguali offerte per
corrispondenza avrà la precedenza quella giunta per prima e in ogni caso esse
hanno priorità su offerte uguali in sala). Gli scatti delle offerte saranno regolati
a discrezione del banditore. Lo scatto minimo sarà di € 25,00. Il banditore si
riserva il diritto di ritirare, aggiungere, raggruppare o dividere i lotti, nonché il
diritto di rifiutare un’offerta in sala o inviata per iscritto.
6 – Prezzo d’acquisto
Verrà addebitata all’acquirente una commissione di acquisto a favore di Aste
Bolaffi, oltre al prezzo di aggiudicazione, nella misura che segue:
Asta numismatica e filatelica: il prezzo di aggiudicazione sarà maggiorato del
22%, IVA e spese incluse.
Asta memorabilia, ordini e decorazioni: il prezzo di aggiudicazione sarà
maggiorato del 25%, IVA e spese incluse.
Per tutte le altre aste: l’acquirente corrisponderà su ogni lotto oltre al prezzo
di aggiudicazione le seguenti commissioni d’asta:
sulla quota del prezzo di aggiudicazione da € 10 a € 50.000 25%
sulla quota del prezzo di aggiudicazione da € 50.001 a € 200.000 22%
sulla quota del prezzo di aggiudicazione da € 200.001 e oltre 20%
Sui lotti acquistati online in qualsiasi asta verrà applicata una commissione
aggiuntiva se prevista.
7 – Lotti con IVA ordinaria
Il simbolo ± dopo il numero di lotto indica un regime di fatturazione con IVA
ordinaria e con commissioni d’asta diverse da quelle normalmente in uso per
i lotti in regime del margine (vedi paragrafo 6).
Il prezzo di aggiudicazione sarà maggiorato di:
1. Commissioni d’asta al 18%
2. IVA sul prezzo di aggiudicazione alle seguenti aliquote:
libri 4%
francobolli 10%
tutte le altre categorie 22%
3. IVA al 22% sulle commissioni.
Terms and Conditions of Sale
1 – Introduction
These general conditions regulate the sale at auction and/or private
negotiations of the lots transferred to Aste Bolaffi S.p.a. (hereinafter
“Aste Bolaffi”). Lots put up for auction are the property of the consi-
gnors, who have guaranteed their complete availability and legitimate
and legal provenance. Aste Bolaffi acts exclusively as a representative
of the individual consignors, in its own name and on their behalf. The
consignor guarantees the authenticity of each lot offered in the catalo-
gue, without hidden defects unless otherwise stated in the catalogue
and/or by the auctioneer. Any indication of the state of preservation of
the lots is not to be considered binding.
2 – Images
The copyright in all images, illustrations and written material produced
by or for Aste Bolaffi relating to a lot or to a specific contents of this
catalogue, is and shall remain at all times the property of Aste Bolaffi
and shall not be used by the buyer, nor by anyone else, without Aste
Bolaffi prior written consent.
3 – Participation in the saleroom
Aste Bolaffi reserves the right to request information from the partici-
pants in the bidding as regards their identity and bank references, as
well as the right to refuse undesirable elements entry to the saleroom.
If the participant is acting in the name and on behalf of another phy-
sical or legal person, a valid power of attorney must be exhibited prior
to the auction.
4 – Participation by correspondence, telephone link, online
By signing and submitting the special forms, the participant agrees
to participate in the auction referred to and undertakes to pay the
purchase price hammered if his/her offer(s) should be successful. The
participant also takes responsibility for ascertaining, after the auction,
whether his/her offer has been successful, relieving Aste Bolaffi of any
liability in that respect. Claims due to negligence or error in filling out
written offers by mail will not be accepted. Aste Bolaffi has no liability
toward those who participate in the auction by telephone link and/or
online in case of failure to participate due to possible problems that
may occur during or prior to the telephone and/or internet connection.
5 – Bids
to cancel the award in case of possible contestations. No bids will be
accepted for any lot below its starting price. No “without limit” bids, or
“upon examination” bids or bids which combine two or more lots will
be accepted. The starting price is the price indicated as the base price,
unless different, higher offers have been received, in which case the
starting price will be that of the increment subsequent to the next to
last offer. (In case of identical commission bids, the first to arrive will
receive precedence, and in any case these take precedence over equal
offers made in the saleroom). The size of increments will be regulated
at the auctioneer’s discretion. The minimum increment will be € 25.
The auctioneer reserves the right to withdraw, add, group or divide lots,
as well as the right to refuse a bid in the saleroom or a commission bid.
6 – Purchase price
A commission in favor of Aste Bolaffi will be charged to the buyer, in
addition to the hammer price, as follows:
Numismatic and philatelic auctions: The Buyer shall pay a premium
of 22% on the hammer price (the price at which a lot is knocked down)
V.A.T. included.
Memorabilia, orders and decorations auctions: The Buyer shall pay
a premium of 25% on the hammer price (the price at which a lot is
knocked down) V.A.T. included.
All other auctions: The Buyer shall pay the following premium on the
hammer price:
Portion of the hammer price from € 10 to 50,000 25%
Portion of the hammer price from € 50,001 to 200,000 22%
Portion of the hammer price from € 200,001 20%
For lots purchased online in any auction an additional commission will
be applied if stated.
7 – Lots with additional VAT
Lots with ± symbol are invoiced differently and have a different buyer’s
premium on hammer price (for margin scheme lots see paragraph 6)
Hammer price will be increased by:
1. Buyer’s premium of 18%
2. VAT on hammer price at the following rates:
books 4%
stamps 10%
all other categories 22%
3. VAT payable at 22% on buyer’s premium
